HIPAA Notice of Privacy Practices

This Privacy Police describes how your health care information may be used and disclosed and how you can get access to this information. Please review it carefully. By using this website, you agree to the terms of this Privacy Policy.

This Notice of Privacy Practices (“Notice”) describes the privacy practices of Wellness Rx, LLC. The Privacy Policy will help you understand how we collect and use personal information from those visiting our website or make use of our online services. Our Policy has been designed and created to ensure those affiliated with Wellness Rx, LLC of our commitment and realization of our obligation not only to meet, but to exceed, most existing privacy standards. We reserve the right to make changes to this Policy at any given time. If you want to ensure you are up to date with the latest changes, we advise you to frequently visit our website. If at any point in time Wellness Rx, LLC decides to make use of any personally identifiable information on file, in a manner vastly different from that which was stated when the information was initially collected, the user or users shall be promptly notified via email of telephone. Users at that time shall have the option as to whether to permit the use of their information in this separate manner.

This policy applies to Wellness Rx, LLC and it governs all data collection and usage by us. Your personal information provided to us may be collected and used. This information may be stored when provided to us or to our service providers. Some examples include product or service information, e-mail alerts, and any other notification when you specify that you are interested in receiving information. When it comes to your health information you have the right to request a copy of your medical record if needed. A copy will be provided of your health information within 30 days of the request. If any correction needs to be made regarding any medical record or health information, please contact us to make the change. We may deny your request but will inform you in writing within 60 days of the request. You may request to contact you in a specific way that you would like (for instance home or office phone or if you would like to have mail sent to a different address).

You may ask us not to use or share specific health information for treatment, payment, or any other operations. We are not required to agree to your request, and we may reject the request if it can affect your care. If you pay for a service or healthcare item out-of-pocket in full, you may ask us not to share that information for the purpose of payment or our operations with your health insurer. We will agree to the request unless a law requires us to share that information. You may ask for a list of the times we have shared your health information for six years prior to the date you ask, who we shared it with, and why. We will include all the disclosures except for those about treatment, payment, and health care operations, and certain other disclosures (such as the ones you request). We’ll provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another one within 12 months. You may ask for a paper copy of this notice at any time, even if you have agreed to receive the notice electronically. We will provide you with a paper copy promptly. If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information. We will make sure the person has authority and can act for you before we take any action.

If you believe your privacy health rights have been violated, you have the right to file a complaint with the Secretary of the U.S. Department of Health and Human Services for Civil Rights by sending a letter to the following address: 200 Independence Ave, S.W. Washington, D.C. 20201, calling 1-877-696-6775, or by visiting www.hhs.gov/ocr/privacy/hipaa/complaints/. We will not retaliate against you for filing a complaint.

It is always up to you whether to disclose personally identifiable information to us, although if you elect not to do so, we reserve the right not to register you as a user or provide you with any products or services. You may tell us what you may want us to share, and we will follow your request. You have the right and choice to tell us who you want your information shared with. This includes family, close friends, or others involved in your care, sharing information in a disaster relief situation, information in a hospital directory or if we may need to contact you for fundraising efforts. If you are not able to tell us your preference, we may go ahead and share your information if we believe it is in your best interest. We may also share your information when needed to lessen a serious and imminent threat to health or safety. We will never share your information unless you give us written permission regarding marketing purposes or any sale of your information. We do not create or maintain psychotherapy notes at this practice. In the case of fundraising, we may contact you for fundraising efforts, but you can tell us not to contact you again.

We typically use or share health information in various ways. We can use your health information and share it with other professionals who are treating you. For instance, A doctor treating you for an injury asks another doctor about your overall health condition. Also, we can use and share your health information to run our practice, improve your care, and contact you when necessary. For example, we can use health information about you to help manage your treatment and provide services regarding treatment. We can use and share your health information to bill and get payment from health plans or other entities. We may give information about you to your health insurance plan so it will pay for your services.

We are allowed or required to share your information in other ways to contribute it to the public good, such as public health and research. We can share health information about you for certain situations such as: preventing disease, helping with product recalls, reporting adverse reactions to medications, reporting suspected abuse, neglect, or domestic violence, or preventing or reducing a serious threat to anyone’s health or safety. We can use or share your information for health research. We will share information about you if state or federal laws require it, including with the Department of Health and Human Services if it wants to see that we are complying with federal privacy law.

We can share health information about you with organ procurement organizations. Also, we can share health information with a coroner, medical examiner, or funeral director when an individual dies.

We can use or share health information about you for purposes of workers’ compensation claims, for law enforcement purposes or with a law enforcement official, with health oversight agencies for activities authorized by law and/or special government functions such as military, national security, and presidential protective services. We can share health information about you in response to a court or administrative order, or in response to a subpoena.

Wellness Rx, LLC takes precautions to protect your information. We are required by law to maintain the privacy and security of your protected health information. We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information. We must follow the duties and privacy practices described in this notice and give you a copy of it. We will not use or share you information other than as described here unless you tell us we can in writing. If you tell us, you may change your mind at any time. Let us know in writing if you change your mind. We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, in our office and on our website.
